In the new health insurance reform law the states are permitted to create their own high risk pools, expand existing pools, or allow the federal government to create and administer the pools for them.

The following states will operate their own pools:
Alaska, Arkansas, California, Colorado, Connecticut, Illinois, Iowa, Kansas, Kentucky, Maine, Maryland, Massachusetts, Michigan, Missouri, Montana, New Hampshire, New Jersey, New Mexico, New York, North Carolina, Ohio, Oklahoma, Oregon, Pennsylvania, South Dakota, Vermont, Washington, West Virginia, Wisconsin, and District of Columbia.

The following states will allow the federal government to create and manage the pools:
Alabama, Delaware, Georgia, Hawaii, Idaho, Indiana, Louisiana, Minnesota, Mississippi, Nebraska, Nevada, North Dakota, South Carolina, Tennessee, Texas, Virginia, and Wyoming.

State senators and advocates for California health insurance are calling on Attorney General Jerry Brown to join other states in suing the federal government over health insurance reform. They feel that congress cannot force the American people to buy individual health insurance.

Thirteen other states including their Attorney General have filed federal lawsuits against the health care overhaul. They feel that the federal government has over stepped its boundaries and is limited to what it can and cannot do by the Constitution.

Consumers could face higher California health insurance premiums and will not have a choice about their purchase. The state would lose billions because the madate is not funded.

Individual health insurance rates are on the rise in four states. Members are seeing increases averaging fifteen percent. People in other states are worried they may face the same dilemma.

The carrier making these drastic increases is Anthem Blue Cross Blue Shield. Regulators have been questioning the carrier for over a week about the devastating individual health insurance increases. California health insurance members are going to see rates rise by as much as 39 percent starting in March.

Anthem Blue Cross California health insurance has postponed their rate increase until May. The adjustment is thirty-nine percent. A very large and devastating increase to member in the state. The increase is quadruple the rate of medical inflation.

The California health insurance adjustments are due to sky high medical costs and a deep cut in healthy membership. The insurance commissioner is keeping a close eye on Anthem Blue Cross. If any compliance issues occur the commissioner will direct the carrier to reduce prices. Not acknowledging this request will result in Anthem Blue Cross losing their license to offer and sell California health insurance.

The Senate has voted to pass a single-payer California health insurance bill. The bill prohibits the sale of a private health insurance policies and establishes a new California Healthcare System.  22 Democrats voted yay and one Democrat joined 13 Republicans to vote nay.

The California health insurance bill will now go to the Assembly. Governor Schwarzenegger has declined similar California health insurance bills in the past. Governor Schwarzenegger has also pledged to veto this bill when it arrives at his desk.

The leading provider of California health insurance, Anthem Blue Cross is threatening a 39% premium hike on individual health insurance policies. This premium increase is catching a lot of intention. This includes the President, Congress, Senate, and of course California health insurance regulators. The government wants to know why such a large increase in premiums and wants Anthem Blue Cross to justify this rate action.

Anthem Blue Cross blames the rate action on increased medical costs and a loss of members due to the recession. There is a thought that because of Obama Care a.ka. health care reform that Anthem is trying to squeeze as much profits out of California health insurance members in case the health care reform bill does pass. If the bill were to pass their profits will drop significantly.

California health insurance : After a lengthy and heated debate, the California Senate last week passed a single-payer bill. As with past incarnations, the bill passed on a party-line vote. Previous attempts to advance single-payer legislation have been vetoed by Governor Arnold Schwarzenegger.

Supporters of the bill claim it would actually cost the state nothing, despite a Senate Appropriations Committee analysis that pegs the cost at $200 billion. Republicans decried the bill as a government take-over of health care. In other news, California in 2011 will become the first state to set legal limits on the time patients must wait to see their HMO doctors. The Department of Managed Health care has announced there will be a maximum wait time of 10 business days for an appointment to see a family practitioner, 15 days to see a specialist, and 48 hours for people seeking urgent care. In addition, doctors’ offices must return telephone calls within 30 minutes. The time limits apply only to doctors in HMOs, which officials say will cover 21 million Californians. A 2002 state law mandated timely access to medical care, and the specifics were worked out after years of negotiations with doctors, hospitals, HMOs and consumer groups. Also, the CEO of the California Medical Association, Alfred Gilchrist, has announced his resignation after serving for just over 2 months.  Gilchrist is returning to his former role as CEO of the Colorado Medical Society.
